How It Works

1. You just need to fill out a questionnaire
We’ll provide you with a questionnaire, or you can call us to go over the questionnaire to obtain the required information.
2. We then work behind the scenes.
We prepare the pleadings and send out the necessary documents to you and your spouse.
3. We get the documents notarized.
Both parties can go to a notary public, or we can arrange for a notary public to come to you and/or your spouse. You then return the documents to us.
4. Wait for the mail.
We mail each you and your spouse one certified copy of the final divorce.

But we’re talking about divorce, right? Or, you might think that there is no such thing as an “uncontested” divorce. If you’re getting divorced, it means that you and your spouse have at least one issue (usually more than one) that you haven’t been able to resolve.
That said, there are some divorces that are more complicated than others, and no-fault divorce is usually simpler than most. A no-fault divorce is a divorce in which neither party is held responsible for the breakup of the marriage. No-fault divorces are granted on the sole reason that you and your spouse have lived separate and apart for 180 to 365 days.

But, what are the rules?
Do you need to get divorced but don’t want the hassle of a contested divorce? Then you’ve come to the right place. But is your situation “right” for this type of divorce?
BOTH PARTIES
- Both you and your spouse wish and agree to get divorced.
- Your spouse agrees to waive service4.
CHILDREN
- If you have children under the age of 18, you would have had to live separate and apart for 365 days without any periods of getting back together for that 365-day period.
- If you do not have children, the time period is 180 days.
- If none of the children are under the age of 18, the time period is 180 days.
- If you both are not the biological parents of the children, then the 180 day time period applies.
Also, please note that if you and/or your spouse are on active military duty, the divorce may take longer.
You will be granted an uncontested divorce based upon living separately and apart for 180 to 365 days. Nobody will be deemed to have been at fault for the divorce.
We only handle uncontested divorces. We do not do divorces involving adopted children or covenant marriages, and this is for divorce only. This does not include child custody, child support, or anything related to community property or property that either of you own. These matters can be handled at another time by another attorney.
